2. DEFINITIONS
For the purposes of these Terms and Conditions:
“Comfy Club”, “we”, “us”, and “our” refer to AMAQHAWE SOLUTIONS (PTY) LTD trading as Comfy Club.
“Customer”, “you”, and “your” refer to any person accessing the website or purchasing products from Comfy Club.
“Website” refers to www.thecomfyclub.co.za and all associated pages.
“Products” refers to all garments, accessories, custom orders, club orders and other goods offered by Comfy Club.

3. WEBSITE USE
You agree to use this website only for lawful purposes. You may not:
3.1 Attempt to gain unauthorised access to any part of the website.
3.2 Interfere with website functionality or security.
3.3 Introduce malicious software, viruses or harmful code.
3.4 Use the website in any manner that may damage Comfy Club’s reputation or operations.
3.5 Copy, scrape or reproduce website content without written permission.

4. PRODUCT INFORMATION
We strive to ensure all product descriptions, images, specifications and pricing are accurate. However:
4.1 Product colours may vary slightly due to screen settings and photography.
4.2 Minor manufacturing variations may occur.
4.3 Product availability is subject to stock levels.
4.4 We reserve the right to discontinue products without notice.
4.5 Errors in product descriptions, pricing or availability may be corrected at any time.

5. PRICING
5.1 All prices displayed on the website are quoted in South African Rand (ZAR).
5.2 All prices displayed are inclusive of Value Added Tax (VAT).
5.3 Shipping charges are calculated separately unless otherwise stated.
5.4 Comfy Club reserves the right to amend pricing without prior notice.
5.5 Pricing changes will not affect confirmed orders already paid for.

6. ORDER ACCEPTANCE
6.1 An order placed through the website constitutes an offer to purchase.
6.2 Orders are only accepted once payment has been successfully received and confirmed.
6.3 Comfy Club reserves the right to decline or cancel orders where:

  • Payment cannot be verified;
  • Pricing errors occurred;
  • Products are unavailable;
  • Fraudulent activity is suspected.
    6.4 If an order is cancelled by Comfy Club after payment has been received, a full refund will be issued.

7. PAYMENT
7.1 Payments are processed securely through approved third-party payment providers.
7.2 Comfy Club does not store full credit or debit card information.
7.3 By placing an order, you warrant that you are authorised to use the selected payment method.

8. SHIPPING AND DELIVERY
8.1 Deliveries are conducted through approved courier partners.
8.2 Delivery timeframes are estimates and are not guaranteed.
8.3 Risk in products passes to the customer upon delivery.
8.4 Ownership of products transfers only once payment has been received in full.

9. RETURNS, REFUNDS AND EXCHANGES
9.1 Returns are governed by our Returns & Refunds Policy.
9.2 Returns requested due to incorrect sizing selected by the customer or change of mind may be subject to return shipping charges and an administrative fee.
9.3 Returned products must be:

  • Unworn;
  • Unwashed;
  • Undamaged;
  • In original packaging;
  • With all tags attached.
    9.4 Custom-made products may not be returned unless required by law.

10. CUSTOM ORDERS
10.1 Custom orders include club apparel, team apparel, event apparel and made-to-order products.
10.2 All custom orders require written approval before production commences.
10.3 Once production has commenced, custom orders may not be cancelled.
10.4 Deposits paid on custom orders may be non-refundable.
10.5 Lead times provided for custom orders are estimates only.
10.6 Custom order enquiries must be directed to info@thecomfyclub.co.za.

11. INTELLECTUAL PROPERTY
All intellectual property associated with Comfy Club remains the exclusive property of Comfy Club. This includes but is not limited to:

  • Logos
  • Branding
  • Product designs
  • Garment prints
  • Artwork
  • Photography
  • Marketing materials
  • Website content
  • Product imagery
  • Graphics
  • Text
  • Layouts
    No intellectual property may be copied, reproduced, distributed, modified, reverse engineered, republished or used for commercial purposes without prior written consent.
    Unauthorised use may result in legal action.

12. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
12.1 Comfy Club shall not be liable for indirect, incidental or consequential damages.
12.2 Comfy Club shall not be liable for delays caused by third-party service providers.
12.3 Comfy Club’s liability shall not exceed the amount paid by the customer for the product concerned.
Nothing in these Terms excludes rights granted under applicable consumer protection legislation.

13. PRIVACY
Personal information is processed in accordance with our Privacy Policy and applicable privacy legislation, including POPIA.
By using this website, you consent to such processing.

14. FORCE MAJEURE
Comfy Club shall not be liable for any failure or delay resulting from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Industrial action
  • Power failures
  • Government restrictions
  • Network outages
  • Acts of God

15. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.

16. CHANGES TO THESE TERMS
Comfy Club reserves the right to amend these Terms and Conditions at any time.
Updated versions will be published on the website and become effective immediately upon publication.
